Start-Up Visa: Entire Team Fails if One Essential Member is Refused

The Start-Up Visa program operates on an all-or-nothing principle. If one essential team member's application is refused, the entire group's dream of coming to Canada fails. Learn why this happens and what Federal Court cases reveal about this high-stakes rule.

Why an Entire Start-Up Visa Team Fails if One Member is Refused

Canada's Start-Up Visa (SUV) program is built on the principle of collective enterprise, but this comes with a critical risk: the entire team fails if one essential member is refused. This is not a procedural quirk but a core feature of the program's regulations, which treat the applicant team as a single, indivisible unit. If one essential member is found inadmissible or their application is refused, IRCC is legally obligated to refuse the applications of all other co-applicants.

The Federal Court has consistently upheld this strict interpretation in Judicial Review proceedings. In cases like Ahmad Reza Narouni Esfahan v. Canada (Citizenship and Immigration), 2026 FC 503, the Court affirmed that an application is locked to the team composition at the time of submission. Trying to amend the application later by removing the failed member is not a solution; a completely new application is required. Similarly, in Achacoso v. Canada (Minister of Citizenship and Immigration), 2025 FC 876, the Court deemed a legal challenge 'moot' because a co-applicant's failure meant the remaining members' cases had a foregone conclusion of refusal.

This interdependence also extends to processing, where security delays for one member can halt the entire group's file indefinitely, as seen in Seyed Mostafa Salehi v. Canada (Citizenship and Immigration), 2025 FC 1590. For SUV applicants, this means:

  • The fate of your application is directly tied to every essential co-applicant.
  • Thoroughly vetting your partners' immigration histories is as crucial as vetting their business acumen.
  • If your team composition changes due to a refusal, you must start the application process over with a new commitment certificate.
